FixFigure – Upload Disclaimer and Terms of Use

Important Notice Before Uploading

By uploading a file to FixFigure, you confirm and warrant that:

• You are the rightful owner of the document or have obtained all necessary rights, licences, or permissions from the copyright holder to upload, process, and analyse the file.
• You understand that certain documents – including building inspection reports – may contain copyright notices, disclaimers, or contractual restrictions. You agree that it is your sole responsibility to ensure compliance with any such terms or limitations.
• You acknowledge that FixFigure processes files solely to provide private, indicative insights to you as the uploader, and does not publish, redistribute, or otherwise use your content beyond this purpose.
• You agree that any limitations, exclusions, or disclaimers contained within the uploaded document (e.g. from the original inspector or report provider) shall be deemed to also apply to FixFigure’s summarised output, and that any references to the original author or inspector are, for the purposes of our analysis, to be read as references to FixFigure.
• You acknowledge that the analysis and estimates generated by FixFigure are indicative only, and provided for general informational purposes. They should not be relied upon as professional advice. You are strongly advised to consult qualified tradespeople, builders, or relevant experts to obtain independent quotes and assessments before making financial, legal, or renovation decisions.
• You understand that all analysis is prepared in reliance on the accuracy, clarity, and completeness of the information contained in the uploaded document. If the document is poorly worded, inaccurate, or missing key information, FixFigure’s output may be limited or misleading as a result.
• You acknowledge that FixFigure may use aggregated insights or recommendations across multiple documents to improve general accuracy, cost estimates, or product features – however, this is never done in a way that identifies, isolates, or exposes any individual user's data, documents, or recommendations.
• FixFigure stores uploaded files and analysis outputs in accordance with New Zealand data handling standards. Data is retained only for the purpose of supporting system and platform functionality (e.g. re-access, analysis audit trails, product improvements), and is never shared unless you explicitly provide consent.

FixFigure accepts no responsibility for inaccuracies or errors resulting from the source material.

You agree to indemnify FixFigure from any claims, losses, or liabilities arising from your breach of these representations or the use of copyrighted or unauthorised content.

User Content, Legal Warranties, and Indemnity

You are solely responsible for all files, documents, and content you upload to the FixFigure platform. By uploading content, you represent and warrant that:

• You are the legal owner of the content or have secured explicit permission or licence from the rightful owner to upload, analyse, and use the material;
• The content does not infringe any third-party intellectual property rights, contract terms, or confidentiality obligations;
• You understand and accept that any limitations, exclusions, or disclaimers expressed in the uploaded document (such as those included by a building inspector) shall be incorporated into and apply equally to FixFigure’s outputs;
• You grant FixFigure a limited, non-exclusive right to access, process, and analyse the content solely for the purposes of generating private, indicative information for your personal use. This licence does not permit FixFigure to retain, reuse, or publish the content for any unrelated purpose.
• You acknowledge that FixFigure may analyse recommendations in aggregate across users to identify trends, improve estimate reliability, or inform general product enhancements – but this data is never used in a way that links back to any individual file, user, or address.
• Uploaded files and analysis outputs are securely stored and handled in line with New Zealand data standards, and are only retained to support platform features such as re-access, user history, or product refinement. They are not disclosed or shared without your explicit authorisation.

FixFigure disclaims all liability arising from any reliance placed on the summaries or cost estimates produced. All outputs are generated using automated processes and are intended for general guidance only. They do not constitute professional building advice, legal guidance, or financial recommendations. You are strongly encouraged to seek independent advice from qualified professionals before taking action based on any output generated by the FixFigure platform.

FixFigure reserves the right to delete uploaded content that appears to infringe third-party rights, breach terms of service, or violate applicable laws. Users agree to indemnify and hold harmless FixFigure and its affiliates from any and all liability, damages, or expenses arising from:

• The unauthorised upload or use of third-party documents;
• Any breach of the representations set out above;
• Any misuse of outputs generated from the FixFigure platform.
